Preamble

SIHO, a brand belonging to Saman, markets products from the plant and animal world.

  1. Object

The purpose of these general conditions of sale (hereinafter referred to as "the GCS") is, on the one hand, to determine the rights and obligations of Saman and its customers and, on the other hand, to define the conditions and methods in which internet sales of products distributed by Saman take place.

These GCS govern the sale of products between SIHO, a brand belonging to Saman and its customers, exclusively on the website www.thesihoeffect.com

These T&Cs apply only to retail and end consumers. If this were not the case, any order would be considered void by Saman.

These GCS apply to the exclusion of all other conditions, in particular those in force for traditional distance sales (telephone and post) offered in promotional mailings sent by post to customers and prospects and to the exclusion of the conditions dedicated to health food stores.

These T&Cs apply without discrimination to all customers in the context of sales of all products distributed by Saman via the website www.thesihoeffect.com

Any order of products from SIHO, brand of Saman, necessarily entails, as substantial and determining conditions, the unreserved acceptance of these GCS.

  1. Products

3-1. Product Features

The products offered for sale are those listed on the website. thesihoeffect.com on the day of their consultation by the customers (hereinafter referred to as “the Product(s)”).

Each Product will be the subject, as far as possible, of a descriptive sheet which will contain the essential characteristics of the said Product and its price.

SIHO strives to satisfy its customers by offering them a limited range of products from the plant and animal world. His philosophy aims to prevent most common ailments through simple gestures. Its products are at a so-called physiological dose, and taking them does not interfere with any medical treatments. In case of doubt, SIHO listens to customers and is at their disposal for any additional information but in any case advises the opinion of the attending physician for questions relating to health.

Customers have the option of contacting SIHO's Customer Service to obtain additional advice relating to the Products, by email via the "contact" section of the thesihoeffect.com website.

The Products marketed on thesihoeffect.com comply with French and European laws and regulations. It is, however, up to customers to find out from the local authority in their country about any restrictions on the importation and use of the products ordered.

SIHO cannot be held responsible for the purchase of a Product considered as a prescription drug in a given country, while this Product is freely available in France.

SIHO therefore recommends that customers obtain prior information from the competent authorities in their country about any purchase restrictions or for the purchase of a Product containing substances prohibited in a given country.

3-2. Product Availability

Product offers distributed by SIHO via thesihoeffect.com website are valid for the time of their publication and within the limits of available stocks.

Between the moment of validation of the Order and the preparation of the package, a shortage of stock may therefore occur. Consequently, for all Orders, a message confirming the content of the order and the actual amount debited is sent as final confirmation to customers.

The amount of the payment can then be reduced by the amount of the unavailable items: only the Products delivered are billable.

In the event of total or partial unavailability of an order, the product temporarily unavailable will be sent to customers as soon as it is back in stock.

This unavailability will also be indicated on the invoice corresponding to the order placed, as follows:

"This product will be delivered to you later" = This mention means that the product is temporarily unavailable and that it will be delivered as soon as it is restocked to the customer.

"This product is definitely discontinued" = This mention means that the product is no longer marketed. The customer has a credit corresponding to the price of this product in his customer account.

  1. The costs

The prices of the Products distributed by SIHO are indicated in Euros including tax and excluding shipping and packaging costs. The shipping costs will be indicated before confirmation of the order and are recalled below in the GCS (article 7-2.). Prices include value added tax (VAT) applicable on the day of the order. Any change in the applicable VAT rate will automatically be passed on to the price of the Products sold by SIHO.

SIHO guarantees the prices of the Products marketed over the current year. However, for technical reasons SIHO may have to change the packaging of certain Products. The number of units of Products served will then be equivalent to the commercial indications indicated when the order was registered. The price used to serve an order is the one in effect when the order is registered.

  1. Placing the Order

5-1. Identification and password

During the first order (hereinafter referred to as "Order(s)") and in order to avoid each customer having to re-enter their postal details for each Order, an identifier and a password of at least four ( 4) characters can be entered by the latter. A uniqueness and identifier check is then carried out by the SIHO system. In case of loss of his password, the customer should not hesitate to click on the space "I forgot my password" inviting him to fill in his email address to which a link will be sent inviting him to reset their password.

This password is in no way used to make a payment.

This password will be requested from the customer each time he identifies himself to place an Order.

5-2. Order confirmation

Before the customer validates his Order, he will be reminded of the information relating to the characteristics of the Products, their prices, their quantities and the delivery time of the Order and the fact that his Order implies a payment obligation.

Once the customer has read this information and read and accepted these GTC fully and without reservation, the customer can confirm his Order by clicking on the "validate" icon on the page of the website.

The data recorded by SAMAN then constitutes proof of all transactions made on thesihoeffect.com, by its customers.

The data recorded by the payment system constitutes proof of financial transactions.

At the end of the Order, the customer can print a summary of the Order.

If the customer encounters difficulties when placing his Order, SIHO Customer Service is there to help him: he can contact him by clicking on the email address contact@thesihoeffect.com.

An order confirmation message is sent to the customer as soon as the payment of his Order is validated on the site, thus confirming the sale of the Products. A second email will be sent to him on the day of departure of the package prepared by the SIHO shipping department.

Other emails may subsequently be sent to the customer by direct carriers, in order to know the progress of the delivery of the package.

After the validation of the Order, the latter is final (except exercise of the right of withdrawal by the customer provided for below), no modification of the Order can be taken into account. SIHO may not, in particular, add items to the basket ordered. The customer must place a new Order if he wishes additional items.

  1. Payment terms

6-1. Means of payment

Payment for Orders can be made online:

  • By bank card (Visa, Eurocard, MasterCard or other credit cards).

The bank card is debited six (6) days after the validation of the Order by the customer. This allows SIHO to check the availability of the Products and to prepare the Order before the customer is debited.

  • By PayPal

All Orders are payable in Euros, including all taxes and mandatory contributions. Any bank charges remain the responsibility of the customer (including in the case of a refund).

Furthermore, SIHO reserves the right to suspend or cancel any execution of the Order and/or delivery, regardless of its nature and level of execution, in the event of non-payment or partial payment of any sum due by the customer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the SIHO Site, including on the occasion of previous Orders.

6-2. Payment period

If an amount is not paid on its due date, for any reason whatsoever, the customer must pay SIHO, in addition to the principal, late payment penalties due on the day following the payment date, without prior notice, equal to the legal minimum amount required.

In the absence of a reaction from the customer within a reasonable time, SIHO will send a written formal notice to the customer in order to proceed with the amicable collection through the conclusion of an agreement concluded within fifteen (15) days.

6-3. Payment Security

Payment is made by secure transaction, directly with the partner bank, Banque Populaire.

The payment data exchanged on the merchant site is encrypted by the Banque Populaire server using the "SSL" protocol, the most widely used global standard.

During the banking transaction, all data is stored on the site of the partner bank, Banque Populaire Grand Ouest. No data is recorded by SAMAN.

6-4. Retention of title

SIHO reserves ownership of the Products ordered, delivered and invoiced until full payment of their price.

However, the risks of theft, loss and deterioration of the Products are the responsibility of the customer as soon as they are made available to him.

  1. Delivery

7-1. Delivery locations

SIHO delivers its Products in France (Corsica and Monaco included), in Europe and everywhere else (Maghreb included).

The Products are delivered to the delivery address indicated when the Customer registers the Order.

7-2. Delivery times and costs

Delivery times are 3 to 5 working days.

The times indicated correspond to the average time. They include the time for processing the Order, preparing and delivering the package.

A telephone number will be requested when registering the Order, in order to facilitate the delivery of the package by the carrier.

It is specified here that SIHO cannot be held responsible for delays in delivery of postal services, when the non-performance or failure is attributable either to the customer, or to the fact, unforeseeable and insurmountable, of a third party, or to a case of force majeure. The information provided by the customer during identification or when placing an Order commits the latter: in the event of a lack of information in the information or in the event of an error in the wording of the customer's contact details, SIHO cannot be held responsible for the impossibility in which the company could be to deliver the Order. An Order can only be delivered once. The customer undertakes to receive the goods delivered to the address he has indicated on his order form. The customer agrees to be present at the delivery address when the package is presented by the postal services. In the event that the customer is not present when the package is presented, the customer agrees to come and collect his package from the postal services at the address which will be indicated on the delivery notice and within the time limits indicated. .

In the event of a delay in delivery, excluding cases of force majeure and cases attributable to the postal services, the customer may cancel his Order after sending a formal notice to SIHO to make the delivery within a reasonable period of time which has remained unsuccessful. , by sending a registered letter with acknowledgment of receipt to the following address:

The Order will then be canceled upon receipt of this registered mail with acknowledgment of receipt by Saman, unless the latter has delivered the Order in the meantime.

Saman, in the event of cancellation of the Order in the above hypothesis, will be required to reimburse the customer for the totality of his Order, within fourteen (14) days following the date on which the Order will have been canceled .

7-3. Anomaly, damage, damaged package

If the package has been lost, SIHO undertakes to return a package, eight (8) days after the customer's written complaint.

If the package has been damaged, the customer must contact Customer Service by email, explaining the nature of the damage. SIHO then undertakes to return the damaged product(s) at its expense.

  1. Withdrawal period

Customers benefit from the legal period of fourteen (14) days from the day of receipt of the Order to withdraw and cancel their Order, without having to justify their decision. In the event of an Order where the Products are delivered separately over time, the period begins to run from the receipt of the last Product.

In accordance with article L121-21-2 of the Consumer Code, this right of withdrawal is exercised by means of the form, found in Appendix 1 of these GCS, which must be sent by registered mail with acknowledgment of receipt.

Customers who have exercised their right of withdrawal must return their Order within fourteen (14) days of their decision to withdraw, the return costs remaining at their expense.

SIHO will then reimburse customers within fourteen (14) days of receipt of the package returned by the customer. Customers will be refunded their entire Order and the standard shipping costs of their initial Order.

However, customers lose their right of withdrawal, for the sake of health and hygiene protection, when the products have been unsealed by the consumers themselves.

  1. Legal guarantees

9-1. Legal guarantees of conformity

In accordance with article L133-3 of the Consumer Code, SIHO mentions the existence, the conditions of implementation and the content of the legal guarantee of conformity.

According to the provisions of article L211-5 of the Consumer Code, a good is compliant when it:

Is specific to the use usually expected of a similar good, if applicable:

  • that it corresponds to the description of SIHO and has the qualities presented in sample or model;
  • that it has the qualities that a consumer can legitimately expect following SIHO's public declarations (advertising, labeling, etc.).

Has the characteristics defined by the parties or is specific to the special use sought by the customer, known to SIHO and accepted.

Consequently, SIHO cannot be held responsible for any problem arising from use that does not comply with the recommendations given on the product and on its packaging.

The action in guarantee of conformity is prescribed by two (2) years from the delivery of the Product.

All defects of conformity appearing during the two (2) years following the purchase of the Product are presumed to exist.

The customer cannot make use of the guarantee of conformity according to L.211-8 of the Consumer Code:

when he was aware of the defect at the time of placing the Order;

when he could not ignore the defect when ordering.

When there is a lack of conformity, SIHO will replace the Product. SIHO provides the customer with postage-paid return envelopes that the customer can receive upon simple request to Customer Service.

Returns must be made within one (1) month of invoice issuance.

The customer can obtain the resolution of the contract or its reduction (reduction of the price of the Product) if the defect is major and the deadline for the chosen solution exceeds one (1) month from the request; or that no means are feasible.

9-2. Legal guarantees against hidden defects

In accordance with article L133-3 of the Consumer Code, SIHO mentions the existence, the conditions of implementation and the content of the legal guarantee against hidden defects.

According to the provisions of articles 1641 to 1649 of the Civil Code, SIHO will be bound by the guarantee for hidden defects of the Product sold which render it unfit for the use for which it is intended, or which reduce this use so much that the customer would not have acquired it, or would have given only a lesser price for it, if he had known about them.

The legal warranty covers all costs resulting from hidden defects.

SIHO will not be held liable for apparent defects of which the customer has been able to convince himself, but for hidden defects, even if he would not have known of them, unless, in this case, he has stipulated that he shall not be bound by any guarantee.

The defect must be prior to the sale and render the Products unsuitable for the use for which they are intended.

The customer has the choice:

  • Return the Product and obtain a refund of the price;
  • Keep the thing and get part of the price back.
  • The time limit for taking action is two (2) years from the discovery of the defect.
  1. Personal information

By using the SIHO website, the customer consents to the use of the personal data concerning him and which he has communicated via the operation of the said site. These data are mandatory for the processing of the Order and/or the sending of special documentation by the SIHO departments.

In accordance with Law No. 78-17 of 06/01/1978 relating to data processing, files and freedoms, this website has been declared to the CNIL under the number

In accordance with the Data Protection Act of January 6, 1978, the customer has a right of access, rectification and opposition to personal data concerning him. If he wishes to exercise this right, he just has to make the request via, among other things, the dialogue box on their website. SIHO cannot transfer, rent and/or exchange personal data according to the GDPR law.

SIHO may, for all evidentiary purposes, keep and archive the customer's data confidentially, while respecting the legal retention period for such personal data.

  1. Availability of services

  1. Miscellaneous

SIHO reserves the right to modify these T&Cs at any time.

SIHO reserves the right to suspend or cancel any Order, totally or partially, in the event of force majeure.

The fact that SIHO does not avail itself, at a given time, of one of the provisions of these GCS cannot be interpreted as a waiver to avail itself of it later.

These T&Cs are subject to French law.

  1. Presentation of the site
